This process is different from the trial process as only issues which are brought to the attention of the trial court during the litigation are able to be brought before the appellate court.
Appellate litigation focuses on drafting briefs and arguing at the appellate level. Rather than having another trial, the appellate judges only allow for brief argument on key issues.
